LIMITED WARRANTY
Your spa has been manufactured with the greatest of care and from the best available materials. It is protected by a three-year structural warranty, a one-year plumbing warranty, and a one-year equipment warranty. This warranty is issued to the original purchaser at the original site subject to and in compliance with statutory protection, as may be provided by Federal or State laws.
Oregon Spas (referred throughout these conditions as "the manufacturer") warrants for a period of one year from the date of purchase, in respect to defects found to be due solely to faulty materials or workmanship, that it will repair or replace, at its option, such faulty materials or parts free of charge.
THREE YEAR STRUCTURAL WARRANTY
The manufacturer warranties the structural integrity of the spa shell for three (3) years. A structural failure would be a failure of the shell that would prevent the spa from being used for the purpose for which it was purchased, i.e., spa will not hold water, etc. In the event of such a claim, Manufacturer may repair or replace spa shell at the sole discretion of the Manufacturer.
Cosmetic issues with the spa shell are not covered, i.e., scratches, surface checks or blisters. In the event of a spa shell failure and if the manufacturer deems said shell must be replaced, the manufacturer will replace spa with an equivalent or better spa. The manufacturer will use any usable parts from defective spa shell, i.e., pumps, heaters, etc. but will install all new plumbing on new replacement shell. In the event exact shell is not available for replacement, the manufacturer will provide a new cabinet. The aforementioned remedies will be done at no cost to the purchaser. In such event, reasonable costs for removal of the defective spa and delivery and installation of replacement spa will be the responsibility of the spa owner. The manufacturer reserves the right to an on site inspection by an authorized service representative.
ONE YEAR PLUMBING WARRANTY
A plumbing warranty claim would be limited to hoses, tubes, jets and fittings that are plumbed in the spa and leak. Pump and heater unions that may need tightening occasionally are considered maintenance and are not covered. In the event of a warranty claim, it is imperative the purchaser locate and describe exactly what is leaking and where. In some instances purchaser must remove some or all of the access panels on the skirting to describe the problem to the service technician. Once troubleshooting is done, the manufacturer will make necessary repairs at no cost to the purchaser. Purchaser agrees to any cost in providing access to repair process.
ONE YEAR EQUIPMENT AND PARTS
The manufacturer warrants all parts in spa to be free from defects for one (1) year; i.e., pumps, controller, jets, and heater elements. In the event of a claim purchaser agrees to troubleshoot problem over the phone to determine the cause of problem. Once troubleshoot is done, the manufacturer will send out new replacement part(s) at no cost to purchaser. Defective part(s) must be returned and return freight paid by purchaser. The manufacturer will assist customer with detailed step by step instructions to replacement of part(s).
SPECIAL CONDITIONS
This warranty does not apply to failures or damage resulting from negligence, abuse, misuse, misapplication, improper installation, alteration or modification, chemical corrosion, or connection to a power supply of higher voltage than that stated on the equipment, or power spikes caused by lightning or other causes.
Any spa must have a proper base to set upon such as a level concrete slab, a structurally sound deck or a properly constructed and level wood and gravel base. Structural damage caused by improper installation will void warranty. Damage caused by improper use of chemicals or cleaning agents, allowing undissolved spa sanitizing chemicals to lie on the surface, improper pH balance or other improper water chemistry, are considered abuses and may invalidate this limited warranty. The manufacturer cannot be held responsible for incidental or inconsequential damages nor can any damages exceed the price paid for the spa.
The manufacturer is not responsible for any implied warranties or representations by others and under no circumstances shall the manufacturer be liable for incidental or consequential damages, loss of time, inconvenience, incidental expenses, labor or material charges with the removal or replacement of the equipment, or cost of delivering the goods between the retail purchaser and the manufacturer or their agents.
Under no circumstances shall the manufacturer be liable to pay compensation or damage to any person for any loss, injury or damage to any person or property whatsoever, occasioned by or as a result of the use of this equipment whether arising in contract or in torte, and all warranties expressed or implied save as above, or otherwise provided in writing by the manufacturer, are specifically excluded.
The manufacturer shall reserve the right to determine if the repair is subject to the warranty agreement. For instance, damage caused by physically dropping, mishandling or shock is not covered by warranty.
